HIMACHAL PRADESH STATE COMMITTEE
COMMUNIST PARTY OF INDIA (MARXIST)
9, BAWA HOTEL COMPLEX, SHIMLA - 171003

PRESS RELEASE
Dated: 12/10/2015.

The  Communist Party of India (Marxist) has welcomed the decision of the HP High Court where it has rejected the recruitment done by the VC during the previous regime. The party  shows its serious concern on the gross irregularities committed by the Vice-Chancellor in the recruitment of teachers in various departments of Himachal Pradesh University Shimla.
The incumbent Vice-Chancellor has been perpetually making wrong appointments of teaching faculty since the last four years. There have been gross irregularities in the specification of minimum eligibility for recruitment of teachers at the assistant professors level in the various facilities of the University as there has been total disrespect to the guidelines and regulation prescribed by the University Grant Commission, New Delhi, to recruit teachers at various levels. Not only the University has violated these norms at the level of appointment of assistant professors, there have been many instances where irregularities have been made in the appointments of associate and full professors, and also by violating constitutional norms for SC/ST/OBC and differently-abled candidates.
It is shocking that the University disregarded the norms laid down by the UGC in 2009 and made appointments many times on arbitrary consideration. The selections made to the various posts in 2011 have been recently quashed by the honorable High Court. It is shocking that the University had to take contrary stand in the Honorable High Court than the norms which were criteria to make the now quashed selections. But to top that, University for reason best known to the Vice-Chancellor advertized posts of different teaching positions contrary to UGC norms and the stand they had taken in the Hon’ble high Court and went ahead to hold interviews in many departments though a fresh advertisement in 2014.
The party has stated ,It is shocking that the University did’nt take contingence of the fact that on March 16, 2015, in the matter of P. Sushila v/o others, Honorable Supreme Court of India had ruled that only UGC/NET qualified candidates are eligible for the post of assistant professor. Under the chairmanship of the present Vice-Chancellor, the Executive Council of the University adopted this ruling as the guiding principle to appoint teachers in the University. However, in another meeting held in the month of June 2015, the University took somersault assault and decided that the Hon’ble Supreme Court judgment is not binding on the University and reverted back to the previous rules which the University had contested in the case which recently the Honorable high Court has set aside and went a step further by formulating rules where modifications were made, contrary to the UGC guidelines, to favor the ‘suitable candidates’. Also, University seriously faulted in screening/short-listing the candidates for various posts as many otherwise qualified/eligible candidates were rejected.  Not to stop at that, the latest advertisement expired last month and the Executive Council took unusual decisions to extend the advertisement and thus deprived hundreds of the candidates who became eligible meanwhile to apply for different posts.

The  CPI(M) demands that the Governor sack the incumbent Vice-Chancellor for committing these irregularities in the capacity of Executive head of the University, Chairman of the Executive Council, Screening Committee and Selection Committees, as his actions have caused enormous harm to the academic life of the University and made students suffer for the last four years due to the shortage of the faculties. Also, the process of recruitment should be halted and the University should immediately re-advertize all the available vacant posts in all the teaching departments on the basis of the latest UGC norms and set aside all selections made under the arbitrary advertisement under which current interviews have been being held.
